  • Applicants are responsible for all costs charged by the third-party consultant or the Oklahoma Department of Commerce that will be incurred as a result of participating in the Oklahoma Tourism Development Act (OTDA) process. The amount of such costs will vary based on the scope of the review:

    • The OTDA requires that the Applicant engage, after preliminary approval of the materials submitted by Applicant, an independent third-party consultant or the Oklahoma Department of Commerce (ODOC) to review the application and related information to prepare a written report in connection with the OTDA request. The fee charged by the consultant will be the responsibility of the applicant.
    • If a third-party consultant is preparing the written report, the Applicant must provide proof of payment of consultant fees before ODOC reviews the Consultant's Report. Failure to provide proof of payment will result of suspension of the application review process until proof of payment is received.

  • Economic Impact Supplemental Attachments

    Please upload a detailed explanation on economic impact of project, to include how tourism attraction project:

    1. Shall attract at least twenty-five percent (25%) of its visitors from among persons who are not residents of the State of Oklahoma;
    2. Shall have costs in excess of five hundred thousand dollars ($500,000);
    3. Shall have a significant and positive economic impact on this state considering, among other factors, the extent to which the tourism attraction project will compete directly with existing tourism attractions in this state, and the amount by which increased tax revenues from the tourism attraction project will exceed the sales tax credit allowed;
    4. Shall produce sufficient revenues and public demand to be operating and open to the public on a regular and persistent basis; and
    5. Shall not adversely affect existing employment in this state.

    I affirm that I understand that to be considered for participation in the program:

    • That the Applicant must be in good standing with the Oklahoma Tax Commission.
    • That the project meets all thresholds and standards described in statute.
    • That funds expended before the submission of this application cannot qualify for incentive award.
    • That records pertaining to the project must be maintained for a minimum of thirty-six (36) months after completion
    • That receipt of an award letter does not guarantee acceptance into the TDA program and that acceptance only occurs with the execution of a funding agreement.
